HOW TO ENTER: The Weiman Maid for a Year Contest (the “Contest”) starts 12:00:01 am Eastern Time (ET) on 5/1/08 and ends 11:59:59 pm ET on 7/31/08 (the “Entry Period”). The person who submits the Entry will be referred to herein as “Entrant”. To enter, go online to www.weiman.com anytime during the Entry Period and follow the on-screen instructions: [1] Complete the registration form by providing the information required; [2] in the space provided on the Entry form write an essay of 250 words or less describing what the feeling of clean means to you and why you need and deserve maid service. You may want to include the time you spend on household chores and describe the challenge of daily commitments, your desire to maintain a clean house and to experience the good feeling of clean. Once you have completed your Entry, click the “Submit” button to enter. “Entry” is defined, for purposes of this contest, as including both the Entry Form and the written essay. All entries must be submitted by 11:59:59 pm ET on 7/31/08. Entrants must be legal residents of the 50 United States or District of Columbia (“D.C.”), 18 years of age or older at time of entry. Your essay must be 250 words or less or your Entry will be disqualified. Essay must be submitted in English. Entrant certifies that each Entry is Entrant’s own original creation, executed solely by Entrant, has not won any previous award or been submitted in any other competition and is a previously unpublished and previously un-produced work. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as Entrant’s original creation. Entry must be in keeping with Sponsor’s image and may not be obscene, indecent or otherwise offensive, as determined by judges or Sponsor in their sole discretion, nor can they defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to intellectual property rights, and the right to submit or use same shall not be restricted. Any Entrant whose submitted material contains elements not owned by Entrant will be disqualified. Entries that are incomplete or do not comply with these Official Rules in any way are subject to disqualification. No correspondence regarding entries will be acknowledged or entered into with Entrant except as provided herein. Submission of an Entry, grants Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such Entry and the concepts embodied therein in any way, in commerce and in any and all media worldwide, without limitation or compensation to the Entrant and Entrant may be required to sign a release to that effect. Submission of an Entry further constitutes the Entrant’s consent to irrevocably assign and transfer to the Sponsors any and all rights, title and interest in and to the Entry and the concepts embodied therein. Such rights, title and interest shall include, but are not limited to, all intellectual property, sales and licensing rights. Entries become the sole property of the Sponsor and will not be returned. Entrant may be required to provide, in a form satisfactory to the judges and Sponsor, appropriate legal release(s) for use of the Entrant’s and any other third party’s likeness/photograph in connection with this Contest. PRIVACY & PERSONAL INFORMATION: This promotion is subject to Sponsor’s Privacy Policy posted at http://www.weiman.com/privacy.php. Personal information including name, address, city, state, zip, email, and telephone number collected from an Entrant will be used only for the purpose of judging the Contest and to notify the Entrant in the event his/her Entry is chosen as the Winner, and will not be re-used, sold or shared in any manner by Sponsor, Marden-Kane, Inc. (the “Administrator”), or any third parties unless Entrant has opted-in to receive additional information and promotional materials from Sponsor or third party. Once the promotion has ended all information supplied by entrants who opt not to receive additional information will be removed from the database. JUDGING/NOTIFICATION: All eligible entries will be judged under the supervision of Marden-Kane, Inc., the contest administrator and independent judging organization on the basis of the following criteria: Essay must describe what the “feeling of clean” means to the entrant (40%); Essay should illustrate why entrant needs and deserves maid service (40%); Originality and creativity of the essay (20%). In the event of a tie, the essays involved in the tie will be reviewed by an additional qualified judge who will serve as a tiebreaker and who will evaluate essays according to the above judging criteria. Decisions of judges are final and binding in all respects. The five (5) Grand Prize Winners will be notified by overnight courier, mail, e-mail and/or telephone on or about 8/18/08. Becoming a Winner is subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules. The Grand Prize winners will be required to complete and sign an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, which must be returned within 7 days of initial issuance of written prize notification. If such documents are not returned within the stated timeframe or are returned as undeliverable, the corresponding winner will be disqualified and an alternate winner will be determined based on the judging criteria and notified as per the procedures described above. PRIZES: Five (5) Grand Prizes: a year of biweekly maid service provided by Merry Maids®. Prize has a maximum retail value of $2,600 and a maximum term of one year. Maid service will terminate upon the earlier of reaching $2,600 in services or one year from the date of the selected winners’ first services. Approximate retail value of the prize is $2,600 and depends on the size of the selected winners’ homes and the geographic areas in which they reside. Any difference between actual value and stated value herein will not be awarded. All other expenses not stated herein as part of the prize are the winner’s sole responsibility. Winners are responsible for payment of all applicable income taxes on prize. Winners are responsible for paying any taxes, gratuities and all charges for services that exceed the prize value specified above based on the applicable charges at the time such charges are incurred. Any charges incurred by the winner in excess of the Grand Prize amount shall be the winner’s sole responsibility. Total ARV of all prizes: $13,000. The Prize shall not be shared or transferred. Maid services will be provided to winners by Merry Maids®, and will be paid by the Sponsor on the selected winner’s behalf to a maximum of $2,600. Services must commence no later than two months following prize notification. Prizes are limited to house cleaning services offered by Merry Maids. The prize may not be exchanged in whole or in part for cash or other substitutes, is non-transferable and non-refundable. If a winner does not live in an area serviced by Merry Maids, he/she will receive the cash equivalent. Prize must be accepted “as is”. Sponsor at its sole discretion reserves the right to substitute the prize for a prize of equal or greater value. Limit one prize per person per household. ELIGIBILITY: Entrants must be legal residents of the 50 United States or D.C., 18 years of age or older. Employees of Weiman Products, LLC., Merry Maids LP, their respective parent companies, affiliates, subsidiaries, and advertising and promotion agencies, including but not limited to Marden-Kane, Inc., and members of the immediate families (defined for these purposes as including spouse, parents, children, and siblings and each of their respective spouses) or households of any of the above are NOT eligible to enter or win. Void outside the 50 United States, D.C. and where prohibited by law. Subject to all applicable federal, state and local laws and regulations. By participating and/or accepting the prize, Entrants agree to be bound by these Official Rules and to accept decisions of the Sponsor as final in all matters relating to this Contest. CONDITIONS OF ENTRY: In the event of a dispute as to the identity of an online entrant, entry will be declared made by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, Internet service provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning email addresses associated with the submitted email address. By entering and/or accepting the prize, all participants agree that Weiman Products, LLC., Merry Maids LP, their respective parent companies, affiliates, subsidiaries and advertising and promotion agencies, including but not limited to Marden-Kane, Inc., and the officers, directors, and employees of each of the foregoing (“Releasees”) shall have no liability whatsoever for any injuries, losses, or damages of any kind resulting from or in connection with the acceptance, possession, use or misuse of the prize or participation in this Contest or in prize-related activities (including, without limitation, any travel related hereto). Participants further agree that the Releasees are not responsible for the following: (i) electronic transmissions, entries or submissions that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries or related materials, or for destruction of or unauthorized access to, or alteration of, entries or related material, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents related to or resulting from participation in this Contest, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules (all such entries will be disqualified); (v) printing errors in these Official Rules or in any advertisements or correspondence in connection with this promotion: or (vi) late, lost or stolen mail. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should virus, bugs, fraud or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Contest and in such case to award the prize based on the eligible, non-suspect entries received as of the date of cancellation/suspension. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.
